What to ask your council about FSS

    Do I need to notify the council about my food business?
    Yes. All food businesses in NSW must be notified to their local council under the Food Act 2003 before commencing operation.

    Does my FSS need to be named on my food business notification?
    Yes. Under NSW Food Regulation 2025, you must provide your FSS's name and certificate number when notifying or updating your food business registration.

    What happens if my FSS leaves?
    You must appoint a replacement FSS as soon as practicable. If an inspector visits and no FSS is in place, your business may receive a compliance notice. You have 30 working days to certify a new FSS.

    Does my council conduct food safety inspections?
    Yes. Council environmental health officers conduct routine and complaint-driven inspections of food businesses. They check for a current FSS certificate, food handler training, and food safety records (evidence tool).
